END USER LICENSE AGREEMENT (EULA) FOR VOXPOP

This End User License Agreement ("Agreement") is a binding legal agreement between you (the "User") and the VoxPop Development Team ("we," "us," or "our") regarding your use of the VoxPop mobile application ("Application").

By downloading, installing, or using the Application, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the Application.

1. ACKNOWLEDGEMENT

Both parties acknowledge that this Agreement is concluded between the User and the VoxPop Development Team only, and not with Apple Inc. ("Apple"). The VoxPop Development Team, not Apple, is solely responsible for the Application and the content thereof. This Agreement does not provide for usage rules for the Application that are in conflict with the Apple Media Services Terms and Conditions as of the effective date.

2. SCOPE OF LICENSE

We grant you a non-transferable, non-exclusive license to use VoxPop on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. THE VOXPOP ETHICAL FOUNDATION & USER CONDUCT

VoxPop is built on a foundation of ethical engagement, transparency, and digital well-being. As a condition of this license, you explicitly agree not to use the Application to create, upload, post, or share any User Generated Content (UGC) that:

  • Is defamatory, libelous, or intentionally misleading.

  • Promotes hate speech, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, or disability.

  • Consists of harassment, bullying, or targeted abuse.

  • Contains sexually explicit material, graphic violence, or illegal content.

4. MAINTENANCE AND SUPPORT

The VoxPop Development Team is solely responsible for providing any maintenance and support services with respect to the Application, as specified in this Agreement or as required under applicable law. Both parties acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

5. USER GENERATED CONTENT (UGC) MODERATION AND SAFETY

Because VoxPop values healthy community discourse, we enforce a strict zero-tolerance policy for objectionable content or abusive behavior. By using the app, you acknowledge and agree to the following safety mechanics:

  • Filtering and Moderation: We employ automated and manual review systems to filter objectionable content.

  • Flagging and Reporting: The Application provides built-in mechanisms for users to flag/report objectionable UGC and report abusive users.

  • Swift Action: Reported content or users will be reviewed within 24 hours. We reserve the right to remove content and immediately terminate or suspend the account of any user who violates Section 3 of this Agreement.

6. NO WARRANTY & LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the Application is provided "As Is" and "As Available." In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

7. PRODUCT CLAIMS & LEGAL COMPLIANCE

The VoxPop Development Team, not Apple, is responsible for addressing any claims of the User or any third party relating to the Application or the User’s possession and/or use of that Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. INTELLECTUAL PROPERTY RIGHTS

Both parties acknowledge that, in the event of any third-party claim that the Application or the User’s possession and use of that Application infringes that third party’s intellectual property rights, the VoxPop Development Team, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

9. THIRD-PARTY TERMS OF AGREEMENT

You must comply with applicable third-party terms of agreement when using the Application (e.g., if you are using a data service provider, you must not violate their data agreement while using VoxPop).

10. APPLE AS A THIRD-PARTY BENEFICIARY

Both parties acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
